Acceptance of Terms

These Terms of Use (“Terms”) are a legally binding agreement between you and Bildbot, Inc. (“we,” “us,” or “our”) governing your use of the service at zeer.com (“Zeer” or the “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. You must be at least 13 years old (16 in the EEA/UK) to use the Service. If you are a minor, you must have parental or guardian consent.

Description of Service

Zeer is a business name generator with real-time domain availability checking. The Service uses AI to generate name suggestions based on your input and checks domain availability through RDAP registries. We may also provide referral links to domain registrars. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable efforts to provide notice of material changes.

Acceptable Use

You agree to comply with all applicable laws and must not:

• Violate any applicable laws or regulations
• Transmit harmful, abusive, or offensive content
• Impersonate any person or entity
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the operation of the Service
• Use automated scrapers or bots without our permission
• Introduce viruses, malware, or other malicious code
• Circumvent any security features or rate limiting

User Content and License

You retain ownership of the search queries and content you submit to the Service. By submitting content, you grant us a limited, royalty-free license to use that content for the purpose of providing, maintaining, and improving the Service. We may use aggregated, de-identified data derived from your usage for analysis and research.

Intellectual Property

Bildbot, Inc. owns all rights in the Service, including its content, features, functionality, design, and underlying technology, protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal and commercial name research purposes. You may not modify, reverse engineer, copy, or resell any part of the Service.

Fees

The Service is currently provided free of charge. We reserve the right to introduce paid features or subscription plans in the future, with advance notice.

Third-Party Services

Zeer integrates with third-party services including cloud hosting and infrastructure, AI services, domain registry lookups, analytics, and domain registrar referrals. These services are governed by their own terms and privacy policies. We assume no responsibility for the availability, accuracy, or content of third-party services.

Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Disclaimers

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that domain availability results will be accurate or complete. Domain availability information is provided for informational purposes only and should be verified with the relevant domain registrar before purchase.

Limitation of Liability

To the maximum extent permitted by law, Bildbot, Inc.'s total liability for any claims arising from your use of the Service shall not exceed $100. We are not liable for any indirect, incidental, special, consequential, or punitive damages, except in cases of death, personal injury from negligence, or fraud.

Indemnification

You agree to indemnify and hold harmless Bildbot, Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your submitted content, or your violation of these Terms.

Termination

You may stop using the Service at any time. We may terminate or suspend your access to the Service without prior notice for any reason, including violation of these Terms. You may request deletion of your data by contacting us.

Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules. You may opt out of arbitration within 30 days of first using the Service by contacting us in writing.

Class Action Waiver: You agree to resolve disputes with us on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

Users in the EEA/UK retain the right to bring claims in their local courts as required by applicable consumer protection laws.

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions, except where mandatory consumer protection laws of your jurisdiction apply.

Children's Privacy

The Service is not directed to children under 13 (or 16 in the EEA/UK). If we become aware that we have collected personal information from a child, we will promptly delete it.

International Provisions

Users in the EEA, UK, and Switzerland retain all statutory consumer rights and GDPR protections as described in our Privacy Policy.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a new effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

General Provisions

These Terms constitute the entire agreement between you and Bildbot, Inc. regarding the Service. If any provision is found to be unenforceable, the remaining provisions shall remain in effect. Our failure to enforce any right or provision does not constitute a waiver. We may assign our rights under these Terms without restriction. Neither these Terms nor use of the Service creates any partnership, joint venture, or agency relationship. Section headings are for convenience only and have no legal effect.
